Terms of service

Last updated: 25 October 2026

These terms apply when you use diggingbits.com.au or buy from us. Please read them with our refund policy, shipping policy and privacy policy, which form part of these terms.

1. Who we are

Digging Bits, ABN 23 157 760 793 ("we", "us", "our"), is an online business based in Frankston South VIC 3199, with no shopfront. You can reach us at sales@diggingbits.com.au or on 0434 721 356. Our full details are in our contact information policy.

Our store runs on Shopify. When you buy from us, your contract is with us, not with Shopify.

You need to be 18 or over to place an order, or have a parent's or guardian's OK.

2. Your rights under the Australian Consumer Law

Nothing in these terms or our policies excludes, restricts or changes any right or remedy you have under the Australian Consumer Law, or any other law that can't be excluded. If anything here seems to say otherwise, your legal rights apply.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Most of our customers, including businesses buying gear for their own use, are consumers under the Australian Consumer Law. The manufacturer's warranty shown on each product page comes on top of these rights.

3. Products and fitment

  • Everything we sell is a genuine Digga product. We describe and picture each one as accurately as we can. Colours can look different on your screen, and the product description sets out what's included.
  • Specifications, availability and lead times can change. If something that matters to your order changes, we'll tell you before we place it with our supplier, and you can cancel for a full refund.
  • We check fitment against the machine details you give us: make and model, operating weight, hitch or coupler, hydraulic flow, and for augers your drive's shaft. Please make sure they're right.
  • If an item we checked doesn't fit and the details you gave us were right, contact us and we'll fix it under the Australian Consumer Law. If it doesn't fit because the details were wrong or incomplete, that isn't a fault, and the cancellation terms in our refund policy apply.

4. Prices and payment

  • Prices are in Australian dollars and include GST.
  • Freight is extra and shown at checkout before you pay. Pickup from a Digga branch and your own freight (BYO) are free.
  • We take payment when you place your order. Card payments are processed by Shopify Payments, and PayPal payments by PayPal. We never see or store your full card details.
  • If a price, freight figure or other detail on our site is wrong because of an obvious error, we'll contact you before we place your order. You can pay the correct amount or cancel for a full refund.

5. Orders and cancellations

  • Placing an order is an offer to buy. We accept it when we email you to confirm the lead time and dispatch date, usually within one business day.
  • We may decline an order, for example if an item is no longer available, we can't deliver to your address, or we suspect fraud. If we do, we'll refund you in full.
  • Until we place your order with our supplier, you can cancel for a full refund, with no restocking fee. That includes when the confirmed lead time or freight doesn't suit you.
  • After that, our refund policy sets out when we can cancel or change an order, and which made-to-order items can't be cancelled.

6. Freight, pickup and delivery

  • Our shipping policy sets out freight, free pickup, your own freight (BYO) and delivery times.
  • Delivery times are estimates. If dispatch is delayed past the date we confirmed, we'll tell you as soon as we know, with the new date, and talk you through your options.
  • If freight to your address costs more than checkout showed, we'll contact you before finalising the order. You can pay the difference, switch to free pickup or your own freight, or cancel for a full refund.
  • Your order is our responsibility until it's delivered to you, or collected by you or your carrier. Ownership and risk pass to you at that point.
  • Please check your order on arrival. If anything is damaged, note it on the delivery paperwork, take photos and contact us. Our refund policy covers what happens next.

7. Our chat

The chat on our website may be answered by an AI assistant. It's there to help, but it can get things wrong. Before you order, check the product page and our policies, or ask us. If you ordered because the chat told you something that wasn't right, contact us and you can cancel for a full refund.

8. Using our website

  • Use our website lawfully. Don't misuse it, upload malicious code, try to get around its security, collect other people's information, or copy its content in bulk.
  • Automated tools, including AI agents and bots, must identify themselves as automated, must not get around any measure we use to limit them, and must stop if we ask.
  • The text, images and design on our website belong to us or our licensors, including Digga. You can view, print and share them for your own buying decisions. Please don't reproduce them for anything else without our written OK.
  • Links to other websites are for your convenience. We're not responsible for their content.
  • We may suspend access to our website for anyone who misuses it.

9. Reviews and feedback

If you post a review or send us feedback, you allow us to use it on our website and in our marketing, with your first name and state. Reviews must be honest and about your own experience. We don't remove reviews because they're negative. We may remove a review that is offensive, unlawful, or not about our products or service.

10. Our responsibility

  • Our responsibility for the goods we sell is set out in section 2. Nothing in these terms limits it.
  • Beyond that, and only as far as the law allows, we're not responsible for loss or damage caused by using a product outside the manufacturer's instructions or your machine's ratings, incorrect installation, changes made to a product, normal wear and tear, or events outside our reasonable control, such as severe weather or a carrier shutdown.
  • The information on our website is general. For anything that matters to your job, ask us.

11. Changes to these terms

We may update these terms, for example when the law or the way we work changes. The terms on this page when you place an order apply to that order. If any part of these terms can't be enforced, the rest still applies.

12. Governing law

Victorian law applies to these terms. That doesn't stop you making a claim in your own state or territory, for example through its consumer affairs agency or tribunal.
